Terms and Conditions- Labour Hire Agreement

This agreement (the Labour Hire Agreement) is deemed accepted by Boddington Mechanical and Auto Electrical Pty Ltd (Bodmec) its Client (the Client).


1. Introduction

1.1 The Client and Bodmec have reached agreement on the general terms and conditions which apply to the Client upon requesting Bodmec to provide the Labour Service of its employees to the Client.

1.2 Bodmec will not be bound by any additional or conflicting terms and conditions unless they are accepted in writing by a Direct of Bodmec.

1.3 Any variation to Bodmec’s terms and conditions must be agreed in writing, prior to commencement of works.


2. Rates

2.1 The hourly rates must be agreed by Bodmec and the client before commencement.


3. Minimum Period of Labour Hire

3.1 The minimum period of any work is 12 hours.


4. Termination of Hire

4.1. The Client must provide Bodmec at least ONE (1) Week notice of the termination of hire in writing or otherwise Bodmec will charge ONE (1) Week additional hire.


5. Poaching

5.1 Unless otherwise agreed, in the event the client (or any entity or body associated with the Client) is to engage or retain any Bodmec current employees or former employees (either directly or indirectly) within a period of SIX (6) months of their employment since the commence date, a placement fee equivalent to Two weeks hire (total of 168 Hours) will be payable by the client.

5.2 Unless otherwise agreed, in the event the client (or any entity or body associated with the Client) is to engage or retain any Bodmec current employees (either directly or indirectly) after a period of SIX (6) months of their employment since the commence date, a placement fee equivalent to One weeks hire (total of 84 Hours) will be payable by the client.


6. Occupation Health and Safety and other matters

6.1 It is the client’s responsibility to provide a safe and healthy workplace, and safe system of work for all employees.

6.2 The Client must provide Bodmec employees with:

6.3 Compliance with all occupational, health, safety environmental and associated legislation, regulations and codes of practice;

6.4 Safe equipment and structures;

6.5 Adequate instruction and training to each employee;

6.6 Supervision to employees at all reasonable times;

6.7 In the event of a workplace health and safety incident involving Bodmec employees, the client is to promptly advise Bodmec and both parties must cooperate in any subsequent investigation, and work together to either eliminate the risk of the incident re-occurring as far as reasonably practicable.


7. Review of Rates

7.1 Bodmec reserves the right to review its charge rates every SIX (6) months and amend where is applicable.


8. Bodmec Limitation of Liability

8.1. The Client is responsible for the care and supervision of all employees whilst on hire to the Client.

8.2 Bodmec is not liable for any loss or damage to any property or for death or personal injury (to the Client’s personnel or another person) caused or contributed to by an employee (whether by negligence or otherwise) whilst on hire to the client.
